H. C. R. 33--"Requesting the Joint Committee on Government
and Finance to study Senate Bill 354 and House Bill 2545,
introduced by request of the executive during the 1993 regular
session and relating to the reorganization of the Division of
Environmental Protection."
Whereas,
It was not possible for the bill referred to above,
known as the "DEP Reorganization bill," to receive full
consideration by the Legislature during the regular session; and
Whereas,
The reorganization of the Division of Environmental
Protection has important policy implications for the State and
all its citizens; and
Whereas,
The drafting committee of the Division of
Environmental Protection Advisory Board created pursuant to
section seventeen, article one, chapter twenty-two of the Code
devoted many hours of work to the Reorganization Bill, producing
a significant and complex piece of legislation; and
Whereas,
Most of the Reorganization Bill's content reflects
consensus among many affected West Virginia constituencies on
recodifying the State's environmental statutes; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to create the Division of Environmental Protection
Reorganization Bill Study Committee to thoroughly review the
Reorganization Bill during the interim between sessions. The
committee shall consist of eighteen members: Four members of the
House of Delegates, appointed by the Speaker; four members of theSenate, appointed by the President; eight members appointed by
the Governor, four of whom shall have significant experience in
an industry regulated by the Division of Environmental
Protection, and four of whom shall have significant experience in
the advocacy of environmental protection; and the following two
members who shall serve ex officio: The secretary of the
Department of Commerce, Labor and Environmental Resources and the
Director of the Division of Environmental Protection; the Speaker
and the President shall each designate one of their appointees to
serve as co-chairs of the committee; and, be it
Further Resolved,
That the committee report its findings,
recommendations and conclusions, together with drafts of the
Reorganization Bill, with or without amendments, as the committee
may determine, to the Joint Committee on Government and Finance,
no later than December 1, 1993; and, be it
Further Resolved,
That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
